Terms of Service — Tough Customer

These terms are an agreement between you (or the organization you represent) and Tough Customer governing use of app.toughcustomer.ai and our integrations (Slack, Zoom, Google Meet, Salesforce, and MCP connectors for LLM clients). By creating an account or using the service you accept them.

The service

Tough Customer is an AI sales-training platform: voice roleplays against AI buyers, rubric-based scoring, AI coaching, learning journeys, and analytics. Features evolve; we may add, change, or retire capabilities.

Accounts & workspaces

You must provide accurate information and keep your credentials secure.
Workspace admins control membership, roles, content, integrations, and custom tools for their workspace, and are responsible for having the right to submit the content their team uploads (recordings, transcripts, CRM data).
When you connect a third-party integration you authorize us to access it as configured; that provider's own terms also apply.

Acceptable use

Don't misuse the service: no unlawful content, no infringing others' rights (including recording people without required consent), no attempts to break workspace isolation or probe other tenants' data, no reselling without an agreement, and no use that violates our AI providers' acceptable-use policies.

AI output

Scores, coaching, personas, and other AI output are generated by large language models and can be wrong. They are training aids, not professional advice, and must not be the sole basis for employment decisions. You are responsible for reviewing AI output before relying on it.

Your content & our IP

You keep ownership of the content your workspace submits. You grant us the license needed to operate the service on it (store, process, display to your workspace, and send to our AI subprocessors as described in the Privacy Policy). The service, its software, and its branding remain ours.

Subscriptions

Free tiers are credit-limited. Paid plans are billed per the ordering document or in-app plan terms (seats and/or metered AI usage). Fees are non-refundable except where required by law.

Disclaimers & liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our aggregate liability for any claim is limited to the amounts you paid us in the 12 months before the claim, and neither party is liable for indirect or consequential damages.

Termination

You may stop using the service and request deletion at any time. We may suspend or terminate accounts that violate these terms. Sections that by their nature survive (content licenses already exercised, liability limits, disputes) survive termination.

Changes, law & contact

We may update these terms; material changes are announced in-app and the date above is revised — continued use is acceptance. Questions: support@toughcustomer.ai.
